Welcome to the Terms of Service for Tap Telehealth (this “Agreement”). Tap Telehealth Services are provided by Tap Telehealth and its affiliates or subsidiaries, which are responsible for delivering and supporting the Services available to you (collectively referred to as “we,” “our,” or “Tap Telehealth”). Please review this Agreement carefully before using any Tap Telehealth Services. By accessing or utilizing the Services, you agree to be bound by this Agreement, which constitutes a legally binding contract between you (“you” or “your”) and Tap Telehealth.
For the purposes of this Agreement, “Tap Telehealth Services” refers specifically to the services you are enrolled in or are using, and not to any other services offered by Tap Telehealth that are not directly related to your account. This Agreement is supplemental to, and does not replace, any other documentation or terms you may be required to accept in connection with Tap Telehealth Services.
Tap Telehealth offers online access to telephone or web-based video consultations with licensed physicians, including board-certified specialists, as required by your state.
During these consultations, physicians may provide diagnoses, recommend treatments, and, where appropriate, issue prescriptions for medications.
Tap Telehealth is not intended for use in medical emergencies. If you are experiencing a medical emergency, call 911 immediately or visit the nearest emergency facility.
Tap Telehealth provides access to healthcare Doctors but does not guarantee their qualifications, expertise, or advice.
All healthcare services are provided directly by the Doctors, and reliance on any information or treatment is at your own risk.
Tap Telehealth is not responsible for the outcomes of any healthcare services or recommendations provided by Doctors.
You must provide accurate and complete information when registering to use Tap Telehealth Services. It is your responsibility to ensure that the email address, physical address, and other account-related details you provide are accurate and up-to-date. You must promptly update this information if any changes occur.
You are responsible for maintaining the confidentiality and security of your password and account. Any activities that occur under your account are your responsibility. You agree to:
Tap Telehealth is not liable for any losses or damages resulting from your failure to comply with these obligations.
The following actions regarding your username and password are strictly prohibited:
If you forget your username or password, Tap Telehealth may send a username reminder or temporary password to the email address you provided. Be aware that others with access to the same email address could gain access to your account information if they can answer your security questions correctly.
Your use of Tap Telehealth Services and any associated content must comply with all applicable laws, regulations, and ordinances, including export control laws. You must be at least 18 years old to register and use Tap Telehealth Services or be the parent or legal guardian for a minor under 18 using the Services. Interfering with or disrupting the operation of the Services is prohibited.
If you use a mobile device to access or update your account, you are responsible for safeguarding the device and associated credentials. Leaving your mobile device unattended or failing to secure it may expose your personal information to others. For added security, it is recommended to enable biometric authentication or a passcode on your device.

If you create, share, or display information while using Tap Telehealth Services, you must ensure that the information is accurate and that you own or have the right to use it. Tap Telehealth will handle the information you provide in accordance with its Privacy Policy. The Privacy Policy outlines the types of data collected through Tap Telehealth Services, the measures we take to protect it, and your rights regarding its use and disclosure.
If you interact with Tap Telehealth’s public websites, any information collected will be governed by our Privacy Policy.
Tap Telehealth may contact you regarding your use of the Services. By providing your contact details, you consent to receiving communications through various methods, including email, regular mail, SMS or MMS, push notifications, in app messages, or manual or automated phone calls. These communications may include information about your healthcare, general health related information, public health notices, and Tap Telehealth service related updates. Message and data rates may apply for SMS and RCS communications.
To ensure quality and for training purposes, Tap Telehealth may record both inbound and outbound calls. By using our Services, you consent to such recordings. If you prefer not to have a call recorded, you may request this at the time of the call.
If you provide suggestions, ideas, feedback, or recommendations (“Feedback”) to Tap Telehealth, we reserve the right to use, disclose, reproduce, license, distribute, or otherwise utilize the Feedback as we see fit, without obligation or restriction to you.
The Tap Telehealth Services are owned by Tap Telehealth. We grant you a nonexclusive, limited, and revocable right to access and use the Services for personal purposes during the term of your paid subscription, provided you comply with the terms outlined in this Agreement. You are prohibited from using Tap Telehealth Services for any other purposes, including commercial uses such as co-branding, framing, linking, or reselling any part of the Services without prior written consent from Tap Telehealth.
Materials made available through the Tap Telehealth Services may be accessed, downloaded, or printed strictly for noncommercial purposes and only within the scope permitted by this Agreement. Any other use of these materials requires prior express written authorization from Tap Telehealth. Unauthorized use of any words, images, or other materials from the Services may violate copyright, trademark, privacy, publicity, and other applicable laws.
The content and materials included in Tap Telehealth Services, including their design and layout, may be derived from copyrighted materials owned by Tap Telehealth or its licensed content providers.
The trademarks, service marks, logos, and names displayed within Tap Telehealth Services, whether belonging to Tap Telehealth or third parties, may not be used in advertising, publicity, or to suggest sponsorship or affiliation with any product or service without explicit written permission from Tap Telehealth or the respective third-party owner.
No part of the Services should be interpreted as granting, whether by implication, estoppel, or otherwise, any license or right to use any trademarks displayed within the Tap Telehealth Services without prior written approval from Tap Telehealth or the appropriate third-party owner. The Services may also include additional proprietary notices and copyright information, which must be observed and adhered to.
Users are enrolled in the Tap Telehealth program through their utility provider. The applicable fee for the Tap Telehealth Services is added directly to your utility bill by your utility provider, and Tap Telehealth does not collect payments directly.
Tap Telehealth reserves the right to modify these Terms at any time. Updates will be communicated to users through email or the platform. Continued use of the Services after updates signifies acceptance of the revised Terms.
Except for any equipment or supplies provided by Tap Telehealth, you are responsible for obtaining, installing, maintaining, and operating all necessary software, hardware, or other equipment (collectively, “Systems”) required to access and use Tap Telehealth Services. This includes ensuring you are using up-to-date web browsers, encryption tools, antivirus, anti-spyware, and internet security software to safeguard your access.
You are also responsible for securing internet services through the provider of your choice and for any associated fees or charges imposed by your internet or communications service provider.
You acknowledge and accept the inherent risks associated with using open networks like the Internet, including potential security breaches, data corruption, transmission errors, and interruptions in access. You expressly assume these risks and are responsible for the security of the Systems you use to access Tap Telehealth Services and for the transmission and receipt of information through those Systems.
By choosing to use Tap Telehealth Services, you confirm that you have independently assessed the adequacy and reliability of your internet connection and Systems for this purpose and are satisfied with their performance.
Tap Telehealth is not liable for errors, issues, or interruptions arising from the failure, malfunction, or inadequacy of your internet connection, Systems, or related equipment.
You may choose to authorize a third-party service provider (such as a Personal Health Record provider, healthcare professionals, or other entities selected by you) to access, retrieve, provide, modify, or otherwise use your health and account information. Once you grant access to a third-party provider, they may continue to access your account until you take affirmative action to disable their access.
It is your sole responsibility to evaluate and approve each third-party service provider before sharing your information or accessing their services through Tap Telehealth.
Use of these third-party services and reliance on their content is entirely at your own risk. Tap Telehealth disclaims all liability for any damages or issues arising from or related to your use of third-party services or the content they provide.
Tap Telehealth Services may include content owned by third parties (e.g., articles, data feeds, abstracts) and may provide links to third-party websites. These links and content are provided as a convenience to our users. Tap Telehealth has no control over third-party websites or their content and, as such, does not endorse, sponsor, or assume any responsibility for the accuracy, availability, or quality of the information or services provided by these third parties.
Any opinions or views expressed on third-party websites or platforms are solely those of the third party and do not reflect the views of Tap Telehealth. We are not liable for any claims, damages, or issues arising from your access to or reliance on third-party content, including but not limited to allegations of intellectual property infringement or inaccurate information.
If you click on links to third-party websites from Tap Telehealth Services, it is your responsibility to review and understand the terms and privacy policies of those sites. Tap Telehealth does not guarantee the security or functionality of external sites you choose to visit.
Tap Telehealth Services may include communication between you and Tap Telehealth through SMS or RCS text messages sent to and from your mobile device, as well as email messages. Any information you provide through these channels will be used in accordance with our Privacy Policy and applicable law.
Messaging Program Name and Description
The Tap Telehealth Messaging Program provides informational messages, general health related notices, educational content, public health reminders, and service related updates delivered by SMS or RCS to the mobile number you provide.
Message Frequency
Message frequency may vary and may be recurring based on your communication preferences in your account settings.
Customer Support and Help
If you need help with the messaging program, reply HELP at any time or contact Tap Telehealth Support at 972 688 6330 or support@taptelehealth.com.
Opt Out Instructions
You may stop receiving messages at any time by replying STOP or by updating your communication preferences in your Tap Telehealth patient portal. Opting out of one messaging thread may not cancel all messaging threads in which you are enrolled.
Message and Data Rates
Message and data rates may apply for any messages sent to or from your device.
Carriers Not Liable
Mobile carriers are not liable for delayed or undelivered messages.
Informational Messages
By enrolling to receive SMS or RCS messages from Tap Telehealth, you agree that we may send you informational messages related to your use of the Services. These may include general health information, seasonal health reminders, public health notices, educational content, and updates about Tap Telehealth Services including program features, benefits, and impact. Some messages may be sent using automated or technology assisted messaging systems. These messages are optional and are not required to use Tap Telehealth Services.
Supported Mobile Operators
SMS and RCS messaging is supported by major mobile carriers, including Verizon, T Mobile, AT and T, and Boost Mobile. If your carrier does not support these messages, you may not receive replies. Prepaid mobile users should confirm compatibility with their carrier.
Communication Security Risks
SMS, RCS, and email are not fully secure communication channels and may be transmitted through unencrypted networks. Information sent through these methods may be viewed by anyone who has access to the device or account you use. If you prefer not to receive information in these ways, you may update your preferences in your patient portal.
Email Notifications
Tap Telehealth may send alerts and messages to the email address you provide. Some email messages may contain medical information depending on your communication preferences. Anyone with access to your email account may be able to view this information.
By enrolling to receive SMS, RCS, or email messages, you agree to the terms in this section. If you have concerns about the security of any communication method, please adjust your preferences or contact Tap Telehealth for alternative options.
The Tap Telehealth Services are provided on an “as is” and “as available” basis without any warranties, express or implied. Tap Telehealth, its affiliates, clients, and suppliers disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Your use of Tap Telehealth Services is at your own risk. Access to the Services may be interrupted, and the information, materials, and functionality provided may contain errors or inaccuracies. Neither Tap Telehealth, its affiliates, clients, suppliers, nor anyone involved in creating, producing, or delivering the Services makes any representations or assumes responsibility for the accuracy, completeness, or usefulness of the information, materials, or services provided.
To the fullest extent permitted by law, Tap Telehealth and its affiliates, clients, and suppliers are not liable for any direct, indirect, incidental, special, exemplary, consequential, or punitive damages arising from your use of or inability to use the Services, regardless of the cause.
You acknowledge and agree that these limitations of liability are essential elements of this Agreement and that Tap Telehealth Services would not be offered to you without these limitations.
Please note that certain jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
You agree to indemnify, defend, and hold harmless Tap Telehealth, its affiliates, clients, suppliers, and their respective employees, officers, directors, agents, shareholders, and representatives from any liability, loss, claim, lawsuit, damages, or expenses (including reasonable attorney’s fees and costs) arising from:
This obligation applies to any claims made by third parties as a result of your actions or omissions while using the Tap Telehealth Services.
This Agreement and any disputes arising from or related to it shall be governed by and interpreted in accordance with the laws of the State, without regard to its conflict of law principles. Any disputes between you and Tap Telehealth regarding this Agreement shall be resolved exclusively in the state or federal courts.
Tap Telehealth Services are accessible within the United States, but laws and regulations may vary by state or country. By using the Services, you agree that the laws of the State will govern all matters related to your use of the Services.
This Agreement explicitly excludes application of the United Nations Convention on Contracts for the International Sale of Goods.
Tap Telehealth reserves the right to terminate accounts at its discretion, including but not limited to situations where it determines that your behavior or use of the Services violates applicable laws, this Agreement, or the rights and interests of Tap Telehealth or other users.
Tap Telehealth may also modify, limit, suspend, or terminate the Services entirely or your access to them if you fail to comply with this Agreement or any internal policies. Such actions may result in the deletion of your information, files, or other content associated with your account.
If Tap Telehealth terminates your use of the Services or ceases offering the Services altogether, this Agreement will also terminate. However, the provisions outlined in Sections 2, 3, 4, 5, 8, 9, 10, 11, 12, 13, 14, 15, and any other sections that by their nature should survive termination will remain in effect.

By adhering to these rights and responsibilities, both you and Tap Telehealth ensure the highest quality of care and service delivery.
These Terms and Conditions are specific to you and may not be assigned, transferred, or sublicensed by you without prior written consent from Tap Telehealth. However, Tap Telehealth reserves the right to assign, transfer, or delegate any of its rights or obligations under this Agreement without your consent.
Tap Telehealth uses artificial intelligence (AI) technology to support the healthcare services provided through our platform. AI may be used to suggest potential diagnoses, recommend diagnostic questions, and summarize clinical encounters. All AI-generated suggestions and content are reviewed and approved by a licensed healthcare provider before any diagnosis is made, treatment is recommended, or information is communicated to you.
Some communications you receive, including encounter summaries and health-related questions, may contain content generated or assisted by AI. These communications are reviewed by your healthcare provider before delivery.
AI technology assists but does not replace the clinical judgment of your healthcare provider. Your provider makes all final decisions regarding your diagnosis and treatment.
Your health information may be processed by AI systems to provide these services. All data processing occurs within the United States in accordance with our Privacy Policy and HIPAA requirements.
